Terms of Service

1. Service Description
Gurulu ("we", "us", "our") is a web analytics, error tracking, and customer data platform operated by Monafy. These Terms of Service ("Terms") govern your access to and use of the Gurulu platform, including all related websites, APIs, SDKs, CLI tools, and services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
2. Account Terms
You must be at least 16 years old to use the Service. You must provide accurate and complete information when creating your account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately at legal@gurulu.io if you become aware of any unauthorized access.
3. Acceptable Use
You agree not to: (a) use the Service to collect data in violation of applicable privacy laws or without proper consent from your end users; (b) attempt to reverse engineer, decompile, or disassemble any part of the Service; (c) use the Service to engage in any illegal activity, including unauthorized tracking or surveillance; (d) resell, sublicense, or redistribute access to the Service without our written permission; (e) abuse the Service infrastructure through excessive automated requests or denial-of-service attacks; (f) upload malicious code or attempt to compromise Service security.
4. Data Ownership
Your data belongs to you. We process analytics data, error data, and customer data solely to provide and improve the Service on your behalf. You retain all rights, title, and interest in your data. We do not sell your data to third parties. You may export or delete your data at any time through the dashboard or API. Upon termination, you have a 30-day window to export your data before it is permanently deleted.
5. Intellectual Property
The Gurulu platform, including its software, design, documentation, and all associated intellectual property, is and remains the exclusive property of Monafy. These Terms do not grant you any right to use our trademarks, logos, or brand assets. You may reference Gurulu by name for the purpose of identifying us as your analytics provider.
6. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service is provided on a "best effort" basis. No service level agreement (SLA) applies to free-tier accounts. We may perform scheduled maintenance with reasonable advance notice. We are not liable for downtime caused by factors outside our reasonable control, including internet outages, third-party service failures, or force majeure events.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Gurulu and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or EUR 100, whichever is greater. The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
8. Termination
Either party may terminate this agreement at any time. You may close your account through the dashboard settings or by contacting us. We may suspend or terminate your account if you violate these Terms. Upon termination, you have 30 days to export your data via the API or dashboard. After 30 days, we will permanently delete all data associated with your account. Sections 4, 5, 7, and 10 survive termination.
9. Changes to Terms
We may update these Terms from time to time. We will provide at least 30 days' notice of material changes via the email address associated with your account. Your continued use of the Service after the effective date of updated Terms constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service and close your account before the changes take effect.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from these Terms shall be resolved exclusively in the courts of Istanbul, Turkey. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
